Terms of service

Welcome to Digital Art Junky. These Terms of Service (“Terms”) apply to your use of digitalartjunky.com (the “Site”) and to any products you purchase from Digital Art Junky, LLC (“Digital Art Junky,” “we,” “us”). By using the Site or purchasing, downloading, or using our products, you agree to these Terms and to our User License Agreement. If you do not agree, please do not use the Site or our products.

1. Our Products

We sell digital graphic assets, including brushes, stamps, swatches, color palettes, patterns, and texture images (collectively, “Graphic Assets”), as well as courses and gift cards. Graphic Assets are delivered digitally after purchase.

2. License, Not Ownership

When you purchase a Graphic Asset, you receive a non-exclusive, non-transferable, revocable license to use it. You do not buy ownership of it. All Graphic Assets remain the intellectual property of Digital Art Junky, LLC and/or its contributors. All rights not expressly granted remain with Digital Art Junky, LLC.

Your use of Graphic Assets is governed by our User License Agreement, which is part of these Terms. If these Terms and the User License Agreement conflict, the User License Agreement controls.

3. Who Can Use Our Products

The standard license covers individuals, freelancers, creative agencies, and organizations with less than $250 million USD in annual revenue. Larger companies need an extended license.

4. Users and Devices

The number of licensed users equals the quantity purchased, as shown on your receipt.
Each user may install or use the Graphic Assets on up to two devices for their own use.
Graphic Assets may not be shared with, distributed to, or installed for anyone beyond the licensed user(s).

5. Commercial Use

Brushes and color palettes may be used commercially within the limits in the User License Agreement. Examples include publishing, social media, branding, physical products (up to 250,000 units), and video advertising (up to 500,000 lifetime views).
Stamps and paper textures may not be used in any commercial project. They are limited to non-commercial, personal, or educational use.
Uses beyond these limits require an extended license. Examples include global advertising campaigns and embedding in create-on-demand or DIY customization tools. Contact us to request one.

6. Prohibited Uses

You may not:

Resell, sublicense, share, or redistribute the original Graphic Assets;
Upload Graphic Assets to cloud or file-sharing platforms where others can access them;
Install Graphic Assets in software they are not licensed for;
Reverse-engineer or reproduce Graphic Assets for resale;
Embed editable Graphic Assets in templates or software;
Use a Graphic Asset as the sole design element of a commercial product;
Use stamps or paper textures in any commercial work;
Use any Graphic Asset for illegal, harassing, or defamatory purposes.

7. Modifications

You may modify Graphic Assets for your own permitted use. You may not claim authorship of a modified version or redistribute it.

8. Software Compatibility

Installable Graphic Assets, such as brushes, color palettes, and swatches, are licensed only for the software named on the product page at the time of purchase. For example, Photoshop brushes may be used only in Adobe Photoshop and compatible Adobe iPad apps, not in Procreate, Affinity, GIMP, or other applications. Image-based assets (.JPG, .PNG, .PSD) may be used in any compatible application.

9. Courses

Course access is for the individual purchaser only. You may not share login credentials or copy, record, or redistribute course content.

10. Termination

Your license remains in effect until it is terminated. We may terminate it if you breach these Terms or the User License Agreement. If that happens, you must delete all copies of the Graphic Assets.

11. Attribution

Attribution is not required. We do appreciate it when you credit Digital Art Junky in work made with our products.

12. Disclaimer and Limitation of Liability

The Site and all products are provided “as is,” without warranties of any kind, expressed or implied. Digital Art Junky is not liable for any direct or indirect damages, loss of data or profits, or other consequences arising from the use of, or inability to use, the Site or our products. You agree to indemnify and hold Digital Art Junky harmless against any claims, damages, or expenses resulting from your use or distribution of our products.

13. Changes to These Terms

We may update these Terms at any time. Continued use of the Site or our products after changes are posted means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
